Het Hof van Justitie verzekert de eerbiediging van het recht bij de uitlegging en toepassing van de Europese verdragen. Het is de hoogste rechterlijke instelling van de Europese Unie en maakt samen met het Gerecht deel uit van het Hof van Justitie van de Europese Unie.Als gerechtelijke instelling van de Europese Unie voorkomt het Hof dat er verschillen tussen lidstaten ontstaan, doordat het Gemeenschapsrecht naar eigen inzicht uitgelegd en toegepast wordt. Het zorgt er dus voor dat het recht in de Europese Unie voor iedereen hetzelfde is onder alle omstandigheden.
