La Corte di Giustizia garantisce il rispetto del diritto nell'interpretazione e nell'applicazione dei trattati europei. È la più alta istituzione giudiziaria dell'Unione Europea e, insieme al Tribunale, fa parte della Corte di Giustizia dell'Unione Europea. In quanto istituzione giurisdizionale dell'Unione Europea, la Corte impedisce che si creino divergenze tra gli Stati membri, poiché il diritto comunitario viene interpretato e applicato secondo il proprio criterio. Garantisce quindi che il diritto nell'Unione Europea sia lo stesso per tutti in tutte le circostanze.
