L'École judiciaire espagnole est un organisme public, de nature administrative, qui est intégré au Conseil général du pouvoir judiciaire, dont elle dépend tant sur le plan budgétaire qu'organisationnel.
D'un point de vue institutionnel, la dépendance du CGPJ implique également son indépendance, tant de la sphère législative que gouvernementale. De plus, en raison de son emplacement au sein de l'organe de gouvernance des juges, elle n'a pas non plus de lien organique avec la structure juridictionnelle des tribunaux, même si sa raison d'être est d'être au service de ceux-ci et de toute la carrière judiciaire.
