Die spanische Richterakademie ist eine öffentliche, verwaltungsmäßige Einrichtung, die im Obersten Gerichtshof integriert ist und sowohl in budgetären als auch in organisatorischen Belangen von diesem abhängt.
Aus institutioneller Sicht bedeutet die Abhängigkeit vom CGPJ auch seine Unabhängigkeit, sowohl von der legislativen als auch von der gubernativen Sphäre. Zudem hat sie aufgrund ihrer Lage innerhalb des Gremiums der Richter keine organische Verknüpfung mit der gerichtlichen Struktur der Gerichte, auch wenn ihr Daseinszweck darin besteht, diesen und der gesamten richterlichen Laufbahn zu dienen.
