De Spaanse Rechtelijke School is een openbaar orgaan van administratieve aard, dat is geïntegreerd in de Algemene Raad van de Rechtspraak, waarvan het zowel voor budgettaire als organisatorische doeleinden afhankelijk is.
Vanuit institutioneel perspectief houdt de afhankelijkheid van de CGPJ ook zijn onafhankelijkheid in, zowel van de wetgevende als van de uitvoerende macht. Bovendien heeft het door zijn ligging binnen het bestuursorgaan van de rechters geen organieke verbinding met de jurisdictiestructuur van de rechtbanken, hoewel het zijn bestaansreden is om in dienst te staan van hen en van de gehele gerechtelijke loopbaan.
