Dopo la conquista della città di Málaga bisognava iniziare a risolvere i problemi che sorgevano nella città di natura organizzativa, sociale ed economica, come la distribuzione di terre e case urbane e rustiche o le questioni relative alle successioni. Il 7 settembre 1487 iniziarono, grazie a un decreto, la distribuzione di terre, case e l'organizzazione della città, poiché cominciava ad arrivare la popolazione. Ma non fu fino al 29 giugno 1489 che si costituì l'atto di costituzione del Comune. Fu nella attuale piazza della Costituzione che fu costruito il primo edificio realizzato espressamente per il Comune.
