Na de verovering van de stad Málaga moest men beginnen met het oplossen van de problemen die zich in de stad voordeden van organisatorische, sociale en economische aard, zoals de verdeling van grond en stedelijke en landelijke huizen of erfgenamen. Op 7 september 1487 begon, dankzij een cédula, de verdeling van grond, huizen en de organisatie van de stad, omdat de komst van de herinwoners begon. Maar het was pas op 29 juni 1489 dat de akte van de oprichting van het Stadhuis werd vastgesteld. Het was op het huidige plein van de Constitutie waar het eerste gebouw speciaal voor het Stadhuis werd gebouwd.
